  60. InterActual player 2.0 is NOT a DVD decoder or player.  It is an enhanced Interactive
  61. environment which requires a fully functional DirectShow compliant DVD decoder installed.

  63. InterActual Player 2.0 and InterActual ROM content is not compatible with Macintosh operating systems.

  65. Section 2:  Before Installing the software
  66. -----------------------------------------------------
  67. Shutdown any applications that are running, and disable any screen savers before 
  68. using or installing the InterActual Player.

  71. Section 3:  Installing InterActual Player
  72. -----------------------------------------------------
  73. Insert the DVD into the DVD-ROM drive on your computer.  The InterActual player
  74. should automatically prompt you with an installation dialogue.  If this does not occur:
  75. for Windows 98SE, ME, and 2000, double click the "my computer" icon on your desktop.
  76. Right click your DVD-ROM drive and select "Explore".  Double click the Install.exe file.
  77. for Windows XP, Click the "Start" button and select the "My Computer" icon.
  78. Right click your DVD-ROM drive and select "Explore".  Double click the Install.exe file.

  83. Starting InterActual Player:

  85. Double click the InterActual Player icon on your desktop or click the "Start" button, 
  86. select "Programs", select the "InterActual" Folder then launch "InterActual Player" 
  87. within the "InterActual Player" folder.

  90. the "?" mark button at the top left on the main player window.

  99. To uninstall the InterActual Player Software on your computer, select the Control
  100. Panel and double click the  "Add/Remove Programs" icon. Select "InterActual Player"
  101. then select click the Add/Remove button.  Another method is to click the "Start" button, 
  102. select "Programs", select the "InterActual" Folder then launch "InterActual Player Uninstall" 
  103. within the "InterActual Player" folder.

  115. PLEASE READ THIS DOCUMENT CAREFULLY BEFORE USING THE ENCLOSED SOFTWARE.  
  116. THIS AGREEMENT LICENSES THE USE OF THE ENCLOSED SOFTWARE TO YOU AND 
  117. CONTAINS WARRANTY AND LIABILITY DISCLAIMERS.  BY USING THE ENCLOSED 
  118. SOFTWARE, YOU AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT. IF 
  119. YOU DO NOT AGREE WITH THESE TERMS, CANCEL THIS INSTALLATION PROGRAM 
  120. AND DO NOT USE THIS SOFTWARE. INSTEAD, USE THE DVD PLAYER APPLICATION 
  121. THAT CAME INSTALLED WITH YOUR COMPUTER OR DVD UPGRADE KIT, OR DVD OR 
  122. DMR PLAYBACK SYSTEM.
  123.  
  124. 1. Definitions
  125.    (a) " InterActual Software" means the software programs included 
  126. in the enclosed package or on the DVD, and all related updates 
  127. supplied by InterActual.
  128.    (b) " InterActual Product" means the InterActual Software and the 
  129. related documentation and models and multimedia content (such as video, 
  130. animation, sound and graphics), and all related updates supplied by 
  131. InterActual.
  132.     (c) "Approved System" means any PC running the Windows operating 
  133. system or any Macintosh computer running MacOS, or any DVD or DMR 
  134. Playback System ("System") that has been certified by InterActual 
  135. as "InterActual Compliant", as evidence by InterActual's logo on the 
  136. System or as stated in the System documentation.
  137.  
  138. 2. License.  This Agreement allows you to:
  139.    (a) Use the InterActual Software on a single computer or a single 
  140. System at a time.  The InterActual Software is licensed only for use 
  141. on an Approved System.
  142.    (b) Make one copy of the InterActual Software in machine-readable 
  143. form solely for backup purposes.  You must reproduce on any such copy 
  144. all copyright notices and any other proprietary legends on the 
  145. original copy of the InterActual Software.
  146.    (c) Certain InterActual Software is licensed with additional 
  147. rights as set forth in the Supplementary Rights Addendum that may 
  148. be included in the package for this InterActual Product.
  149.  
  150. 3. Supplementary Licenses.  Certain rights are not granted under 
  151. this Agreement, but may be available under a separate agreement.  
  152. If you would like to enter into one of the Supplementary Licenses 
  153. listed below, please contact InterActual.
  154.    (a) Site Licenses.  You must enter into an InterActual Site 
  155. License if you wish to make copies of the InterActual Software for 
  156. use with additional CPU's owned by you.
  157.    (b) Distribution License.  You must enter into an InterActual 
  158. Run-Time Distribution Agreement if you wish to copy and distribute 
  159. an End-User Product (and its associated InterActual Run-Time) 
  160. other than as set forth in Section 2.
  161.  
  162. 4. Restrictions.  You may not make or distribute any copy of the 
  163. InterActual Product, or electronically transfer the InterActual 
  164. Software from one computer to another or over a network or from 
  165. one System to another.  You may not decompile, reverse engineer, 
  166. disassemble, or otherwise reduce the InterActual Software to a 
  167. human-perceivable form.  You may not modify, rent, lease, lend, 
  168. resell for profit, distribute or create derivative works based 
  169. upon the InterActual Software or any part thereof.  You will not 
  170. export or reexport, directly or indirectly, the InterActual Product 
  171. into any country prohibited by the United States Export 
  172. Administration Act and the regulations thereunder.
  173.  
  174. 5. Ownership.  The foregoing license grants give you limited rights 
  175. to use the InterActual Software.  Although you own the disk or 
  176. CD-ROM on which the InterActual Software is recorded, you do not 
  177. become the owner of, and InterActual (and its licensors) retains 
  178. title to, the InterActual Product, and all copies thereof, and all 
  179. associated patent rights, copyrights, trade secret rights and other 
  180. intellectual property rights therein and thereto.  All rights not 
  181. specifically granted in this Agreement are reserved by InterActual.
  182.  
  183. 6. Limited Warranties.
  184.    (a) InterActual warrants that, for a period of ninety (90) days 
  185. from the date of delivery (as evidenced by a copy of your receipt): 
  186. the media on which the InterActual Software is furnished will be 
  187. free from defects in materials and workmanship under normal use.  
  188. EXCEPT AS SET FORTH IN THE FOREGOING LIMITED WARRANTY, THE 
  189. INTERACTUAL SOFTWARE IS PROVIDED "AS IS", AND WITHOUT WARRANTIES 
  190. OF ANY KIND.  INTERACTUAL DISCLAIMS ALL OTHER WARRANTIES, WHETHER 
  191. EXPRESS, IMPLIED OR STATUTORY, INCLUDING, WITHOUT LIMITATION, 
  192. THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR 
  193. PURPOSE, ANY WARRANTY OF NON-INFRINGEMENT, NON-INTERFERENCE WITH 
  194. ENJOYMENT OR TITLE, ANY WARRANTY OF ACCURACY IN THE INFORMATIONAL 
  195. CONTENT, ANY SYSTEM INTEGRATION WARRANTY, AND ANY WARRANTY THAT 
  196. MAY ARISE BY REASON OF USAGE OF TRADE, CUSTOM OR COURSE OF DEALING.  
  197. IF APPLICABLE LAW IMPLIES ANY WARRANTIES WITH RESPECT TO THE 
  198. INTERACTUAL PRODUCT, ALL SUCH WARRANTIES ARE LIMITED IN DURATION 
  199. TO NINETY (90) DAYS FROM THE DATE OF DELIVERY.  No oral or written 
  200. information or advice given by InterActual, its dealers, 
  201. distributors, agents or employees shall create a warranty or in 
  202. any way increase the scope of this warranty.
  203.    (b) SOME STATES DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, 
  204. SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU.  THIS WARRANTY GIVES 
  205. YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER LEGAL RIGHTS 
  206. WHICH VARY FROM STATE TO STATE.
  207.  
  208. 7. Exclusive Remedies.  Your exclusive remedy under Section 6 is to 
  209. receive a replacement copy of the InterActual Software. InterActual 
  210. will use reasonable commercial efforts to supply you with a 
  211. replacement copy of the InterActual Software.  InterActual shall 
  212. have no responsibility with respect to InterActual Software that 
  213. has been altered in any way or where the non-conformance arises 
  214. out of use of the InterActual Software in conjunction with software 
  215. or hardware that is not supplied by InterActual or that is not an 
  216. Approved System, or with respect to any media damaged by accident, 
  217. abuse or misapplication.
  218.  
  219. 8. Limitations of Damages.
  220.    (a) INTERACTUAL (AND ITS LICENSORS) SHALL NOT BE LIABLE FOR ANY 
  221. INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES (INCLUDING 
  222. DAMAGES FOR LOSS OF BUSINESS, LOSS OF PROFITS, OR THE LIKE), WHETHER 
  223. BASED ON BREACH OF CONTRACT, BREACH OF WARRANTY, TORT (INCLUDING 
  224. NEGLIGENCE), PRODUCT LIABILITY OR OTHERWISE, EVEN IF INTERACTUAL 
  225. OR ITS REPRESENTATIVES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH 
  226. DAMAGES AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE 
  227. FAILED OF ITS ESSENTIAL PURPOSE.  IN NO EVENT SHALL INTERACTUAL 
  228. (OR ANY OF ITS LICENSORS) BE LIABLE FOR THE COSTS OF PROCUREMENT 
  229. OF SUBSTITUTE GOODS OR SERVICES.
  230.    (b) InterActual's total liability to you for actual damages for 
  231. any cause whatsoever will be limited to the greater of $1.00 or 
  232. the amount paid by you for the InterActual Product that caused 
  233. such damages.
  234.    (c) SOME STATES DO NOT ALLOW THE LIMITATION OR EXCLUSION OF 
  235. LIABILITY FOR INCIDENTAL OF CONSEQUENTIAL DAMAGES, SO THE ABOVE 
  236. LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
  237.  
  238. 9. Basis of Bargain.  The limited warranty, exclusive remedies 
  239. and limited liability set forth above are fundamental elements 
  240. of the basis of the bargain between InterActual and you.  
  241. InterActual would not be able to provide the InterActual Software 
  242. on an economic basis without such limitations.
  243.  
  244. 10. Government End Users.  The Government acknowledges receipt of 
  245. notice that the Products and related documentation were developed 
  246. at private expense and that no part of either of them is in the 
  247. public domain.  The Government acknowledges InterActual's 
  248. representation that the Products are "Commercial Computer Software" 
  249. as described in FAR 12.212, DFAR 227.7202 and similar regulations 
  250. issues by the same or other US Government agencies. In no event 
  251. will the Government's rights in the software and the software 
  252. documentation exceed the rights listed in FAR 52.227-19 (Restricted 
  253. Rights).  Unpublished rights reserved under the copyright laws of

  257. 11. General.  This Agreement shall be governed by the internal 
  258. laws of the State of California, excluding conflict or law rules 
  259. and principles and excluding the UN Convention on the International 
  260. Sale of Goods.  This Agreement contains the complete agreement 
  261. between the parties with respect to the subject matter hereof, 
  262. and supersedes all prior or contemporaneous agreements or 
  263. understandings, whether oral or written.  All questions concerning 
  264. this Agreement shall be directed to InterActual at the address 
  265. first written above.

  273. InterActual Technologies, Inc. in the United States and/or other 
  274. countries.  All other trademarks are the property of their 
  275. respective owners.
